Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of Postizi, a social media management platform operated by MFIS Group (McDonald Financial and Insurance Services, Inc.). By accessing or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
Description of Service
Postizi provides a social media management platform that allows users to:
- Schedule and publish content across multiple social media platforms
- Manage multiple social media accounts and organizations
- Collaborate with team members on content creation and approval
- Access analytics and performance metrics
- Utilize AI-powered content generation tools
Account Registration
To use Postizi, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Maintain and update your information to keep it accurate
- Keep your password secure and confidential
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use of your account
You must be at least 18 years old to create an account. By creating an account, you represent that you meet this age requirement.
Acceptable Use
You agree to use Postizi only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Violate any applicable laws or regulations
- Infringe on intellectual property rights of others
- Post or transmit harmful, threatening, abusive, or defamatory content
- Distribute spam, malware, or other harmful materials
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the integrity or performance of our services
- Use our services to violate the terms of any connected social media platform
- Impersonate any person or entity, or misrepresent your affiliation
- Collect or harvest user data without authorization
- Use automated systems or bots in ways that violate platform policies
User Content
You retain ownership of all content you create, upload, or schedule through Postizi ("User Content"). By using our services, you grant us a limited license to:
- Store and process your User Content to provide our services
- Transmit your User Content to connected social media platforms
- Display your User Content within the Postizi platform
You represent and warrant that you have all necessary rights to your User Content and that it does not violate any third-party rights or these Terms.
Third-Party Platforms
Postizi integrates with third-party social media platforms. Your use of these platforms through Postizi is also subject to their respective terms of service. We are not responsible for:
- Changes to third-party platform APIs or policies
- Actions taken by third-party platforms regarding your accounts
- Content published to third-party platforms through our services
- Data collected or processed by third-party platforms
Payment and Billing
Certain features of Postizi may require payment. By subscribing to paid services, you agree to:
- Pay all fees associated with your selected plan
- Provide accurate billing information
- Authorize us to charge your payment method on a recurring basis
All fees are non-refundable except as required by law or as expressly stated in these Terms. We reserve the right to change our pricing with reasonable notice.
Intellectual Property
The Postizi platform, including its design, features, code, and branding, is owned by MFIS Group and protected by intellectual property laws. You may not:
- Copy, modify, or distribute our platform or any part thereof
- Reverse engineer or attempt to extract our source code
- Use our trademarks without written permission
- Remove any copyright or proprietary notices
Disclaimer of Warranties
POSTIZI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- Our services will be uninterrupted, secure, or error-free
- Results obtained from using our services will be accurate or reliable
- Any defects will be corrected
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MFIS GROUP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF POSTIZI.
Our total liability for any claims arising from these Terms or your use of our services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
Indemnification
You agree to indemnify, defend, and hold harmless MFIS Group and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of Postizi
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
Termination
We may suspend or terminate your access to Postizi at any time, with or without cause or notice. Upon termination:
- Your right to use our services will immediately cease
- We may delete your account and User Content
- Provisions of these Terms that should survive termination will remain in effect
You may terminate your account at any time by contacting us or using account settings.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of Postizi after changes take effect constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Minnesota, without regard to conflict of law principles.
Dispute Resolution
Any disputes arising from these Terms or your use of Postizi shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and MFIS Group regarding your use of Postizi and supersede any prior agreements.
